Having helped clients in Florida with probate administration for many years, I can confidently say that probate is not as bad as people make it sound. Unless there is a lot of fighting among heirs, probate can be a fairly quick and easy process if an attorney is involved.

It is vital to have a lawyer help you through the probate process. Although the process itself is relatively short, there are many complex procedures and failing to correctly meet all of the probate requirements can delay distribution of assets. Some of the issues that make probate so complex are:

  • Transferring real estate properly
  • Dealing with creditors — if you don't address this issue, you will not get your distribution
  • Figuring out whether estate tax is owed
